• Floral arrangements: A curated catalog of fresh flower bouquets, plants, and floral designs available for purchase and local delivery
• Custom arrangements: Personalized floral designs created to your specifications for events, occasions, and special requests
• Subscription services: Recurring floral deliveries including our Curated plan ($45/delivery) and Custom plan ($55/delivery), available on weekly, bi-weekly, or monthly schedules
• Local delivery: Delivery within the Sacramento metropolitan area

3. Account Responsibilities

When you create an account with us, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Ordering, Pricing, and Payment

All prices listed on our website are in U.S. dollars and are subject to change without notice. Prices do not include applicable California sales tax, which will be calculated and added at checkout.

We accept payment through Stripe's secure payment processing platform. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, errors in pricing or product descriptions, or suspected fraudulent activity. If we cancel an order after payment has been processed, we will issue a full refund to your original payment method.

Because flowers are natural, perishable products, the actual arrangement delivered may vary slightly from photographs on our website due to seasonal availability. We will always substitute flowers of equal or greater value to match the style and color palette of the arrangement.

5. Delivery Area

Indigo Sun Florals delivers exclusively within the Sacramento metropolitan area, including Sacramento, West Sacramento, Elk Grove, Roseville, Folsom, Rancho Cordova, Citrus Heights, Carmichael, Fair Oaks, Orangevale, North Highlands, Davis, and Woodland. We do not ship flowers outside of this delivery area.

We limit our delivery area to ensure that all flowers arrive fresh and in optimal condition. If your delivery address is outside our service area, we will notify you and offer a full refund. 6. Subscription Services

Automatic Renewal Disclosures: Your subscription will automatically renew at the end of each billing cycle at the then-current rate. You will be charged the plan price per delivery on a recurring basis according to your selected frequency (weekly at $45 or $55/delivery, bi-weekly at $45 or $55/delivery, or monthly at $45 or $55/delivery, depending on your plan). You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing cycle. By subscribing, you acknowledge and consent to these automatic renewal terms.

• You may skip up to 3 consecutive scheduled deliveries (your skip count resets after each completed delivery)
• You may pause your subscription for up to 90 days
• You may cancel your subscription at any time through your account dashboard
• Cancellations take effect at the end of the current billing cycle
• Skips must be requested at least 7 days before the scheduled delivery date to allow for billing processing

7. Order Cancellation

You may cancel an order under the following conditions:

• All orders: May be cancelled within 24 hours of placing the order, provided the order has not yet been prepared for delivery
• Subscription deliveries: May be skipped (up to 7 days before delivery), paused, or cancelled through your account dashboard

8. Intellectual Property

All content on this website, including text, graphics, photographs, logos, icons, and software, is the property of Indigo Sun Florals LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

9. User Content

By submitting reviews, photos, or other content to our website, you grant Indigo Sun Florals LLC a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute such content in connection with our services.

You represent that any content you submit is your own original work, does not infringe on the rights of any third party, and does not contain defamatory, obscene, or otherwise unlawful material. We reserve the right to remove any user content at our discretion.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Because flowers are perishable natural products, we cannot guarantee that arrangements will match photographs exactly due to seasonal availability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Sacramento County, California.

14. Dispute Resolution

If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts as described in the Governing Law section above.

15. Indemnification

You agree to indemnify, defend, and hold harmless Indigo Sun Florals LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our website or services, your violation of these Terms, or your infringement of any third-party rights.

16. Force Majeure

Neither party shall be liable for any delay or failure to perform obligations under these Terms due to circumstances beyond reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, supply chain disruptions, labor disputes, or utility failures. In such events, the affected party's obligations shall be suspended for the duration of the force majeure event.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Indigo Sun Florals LLC regarding your use of our website and services. These Terms supersede all prior agreements, representations, and understandings between the parties.

18. Assignment

We may assign or transfer our rights and obligations under these Terms to any third party without your consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time. Any waiver of a provision must be in writing and signed by Indigo Sun Florals LLC.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
